These terms should be read with a lot of care before Wallinsiders are contracted to do any construction, design, or development services. In availing our services, you submit to the following terms.
Acceptance of Terms
Wallinsiders website at wallinsiders.com, requesting a quote, signing a project contract, or seeking any service, you (herein referred to as Client, you, or your) accept that you have read, comprehended and agreed to be bound by these Terms and Conditions in full.
When you are signing these terms on behalf of a company or other legal entity, you are declaring that you are authorised to bind such an entity. These words are applicable to all the services provided by Wallinsiders, which include but are not limited to home renovation, architecture design, interior design, preconstruction, home exteriors and site development.
You should not accept these terms in their entirety, and when you do not agree with any part of the terms, you are obliged to stop using our services and website at once.
Services Description
Wallinsiders provides the following professional construction and design services across the United States:
- Home Renovation & Remodelling: Interior and exterior residential renovation, kitchen and bathroom remodels, basement finishing, and structural modifications.
- Architecture Design: Custom architectural drawings, design consultation, permit documentation, and code compliance review.
- Interior Design: Space planning, material selection, furniture specification, and complete interior fit-out coordination.
- Preconstruction: Feasibility assessments, cost estimating, scheduling, contractor vetting, and project planning services.
- Home Exteriors: Siding, roofing, decking, driveway installation, and landscape construction.
- Site Development: Land grading, utility connections, drainage engineering, and site preparation for new construction.
Wallinsiders reserves the right to modify, suspend, or discontinue any service offering at any time. We will endeavour to provide reasonable notice of any significant changes.
Project Agreements & Contracts
All construction/design-related projects are required to have their own separately signed Project Agreement prior to work being started. The Terms and Conditions herein are incorporated by reference into all Project Agreements. In case of contradiction between a Project Agreement and the Terms, the Project Agreement terms will prevail in respect of the particular project.
Payment Terms
The schedule of payments will be described in each Project Agreement. Without prejudice to the contrary written agreement, the following is the standard schedule of payments:
- Advance Payment (30%): Due after signing the Project Agreement and commencement of the work.
- Progress Payment (40%): Due after accomplishment of milestone/s as agreed in the Project Agreement.
- Final Payment (30%): Due upon completion of work and walk-through sign-off.
All payments should be paid within 10 business days after issuance of the invoice. Any payment not settled within that period will incur a monthly 1.5% interest on the unpaid amount. Wallinsiders reserves its right to suspend work on any project wherein payment is not settled beyond 15 days.
Licensing, Permits & Compliance
Wallinsiders is a duly licensed and insured general contractor conducting its business in accordance with relevant federal, state, and local laws in the United States. We are covered by general liability insurance, workers’ compensation insurance, and hold all necessary state contracting licenses.
In the absence of a contrary provision in the Project Agreement, Wallinsiders is responsible for procuring all the necessary permits for the project. Permitting fees shall be forwarded to the customer on an incurred-cost basis and reflected in our invoices.
Warranties & Guarantees
Wallinsiders guarantees the workmanship of all projects that we undertake. The company guarantees as follows:
Workmanship Warranty (1 Year)
All workmanship services offered by Wallinsiders are warranted for defects in workmanship for one (1) year from substantial completion of the project.
Structural Workmanship Warranty (5 Years)
The workmanship warranty for load-bearing structural work shall be valid for five (5) years.
Product Warranty
All products used will have a product guarantee provided by the manufacturer.
Warranties will not apply if any of the damages are caused by misuse of the product, alterations made without authorisation, disasters in nature, normal wear and tear, or failure to maintain the product as recommended.
These warranties constitute the total and sole warranty provided by Wallinsiders. There are no additional warranties, either explicit or implicit.
Limitation of Liability
Subject to any applicable limitation on liability provided in these terms, Wallinsiders’ entire liability to the Client for all claims related to or arising from a project shall in no event exceed the total sum actually paid by the Client for such project. Wallinsiders shall have no liability for:
- Any indirect, incidental, consequential, special, or punitive damages of any nature
- The loss of use of the equipment or property involved in performing the work
- Any revenue loss or profit loss of any kind
- Any damage due to existing conditions which the Client failed to disclose
- Any delays or additional costs due to supply-chain disruption or material shortages, or any Act of God
- Subcontractor work not performed directly for Wallinsiders
- Notwithstanding anything else herein, Wallinsiders’ liability for gross negligence, wilful misconduct, or bodily injury is not limited under these terms.
Privacy & Data
Personal data of users is collected and processed by Wallinsiders according to the Privacy Policy, which can be accessed at https://wallinsiders.com/privacy/. When using the services provided by our company, you agree to the collection and use of personal data under the terms and conditions established by the policy.
Our company only uses personal data such as name, address, contact information, and project-related information exclusively for service delivery purposes. Client personal data is not sold, rented, or shared with third parties without the necessity of delivering services or compliance with the relevant legislation.
Project information is stored by our company for seven (7) years after the project completion date.
Changes to These Terms
Wallinsiders may amend or revise these Terms and Conditions from time to time. Significant changes will be conveyed through email communication to our active customers and published on our website with a new “Last Updated” date.
Any further use of our services by you following any amendments or revisions shall constitute your acceptance of the amended terms. We suggest that you review these Terms and Conditions regularly. The Terms and Conditions in effect at the time of signing the Project Agreement will apply to that particular arrangement.
